Update from the Victoria and Esquimalt Police Board – Chief Elsner’s Petition

This is to advise that Chief Elsner’s lawyer has extended the filing deadline for Responses to Chief Elsner’s Petition to April 25th.  The Board will be posting material filed by the Co-Chairs in this matter immediately after it is filed with the Supreme Court.

Background:

On March 14, 2016, Chief Frank Elsner, through his lawyer, filed a Petition in the Supreme Court seeking an Order to quash the Order for an External Investigation made by the Police Complaint Commissioner on December 18, 2015.

Mayor Barbara Desjardins and Mayor Lisa Helps are named in Chief Elsner’s Petition because they were the Internal Discipline Authority that made the discipline decision referred to in the Police Complaint Commissioner’s Order.  As Co-Chairs of the Victoria and Esquimalt Police Board, the Police Act charges both Mayors with the responsibility of internal discipline matters involving the Chief of the Victoria Police Department.

As this matter is now before the Supreme Court, it would be highly inappropriate for the Mayors to comment further.
